Tara Moseley

Tara is an Associate in Clarke Willmott’s Bristol Property Litigation team specialising in residential leasehold matters.

Tara’s expertise includes service charge disputes; Section 20 consultation and dispensation; lease interpretation and breach of lease claims; easements and trespass; forfeiture and possession matters. She has experience of representing clients in the First-Tier Tribunal (Property Chamber), County Court and High Court, and has recently been instructed on a matter that involved an application to the Supreme Court and an appeal in the Court of Appeal.

Tara also has experience of acting in Judicial Review and Statutory Planning Review matters.
Additionally, Tara also has a keen interest in the development of the Building Safety Act 2022 and the impact this has on our clients and regularly advises on these issues. Tara ensures that she keeps up to date of the ever-changing Regulations in this area to ensure our clients are well informed.

Tara is a member of Clarke Willmott’s Social Housing sector team and regularly acts on behalf of Registered Providers.

How Tara can help you

Tara advises on all leasehold management issues relating to residential properties. She has extensive experience dealing with disputes relating to these issues through the Courts and Tribunal and seeking resolution through negotiation and mediation.

Experience

  • Acting for a Registered Provider in an application to the First-Tier Tribunal seeking dispensation from the Section 20 consultation requirements in respect of long-term energy contracts. There were over 11,000 respondents to the application and numerous objections were raised. Despite this, Tara managed the application and successfully obtained the Order from the Tribunal granting dispensation.
  • Advising a Registered Provider in respect of breaches of the lease by leaseholder who was sub-letting. Tara successfully obtained an Order from the First-Tier Tribunal confirming that the breaches had occurred, enabling Tara to then commence forfeiture proceedings seeking possession of the property.
  • Acting for a Registered Provider in relation to a high value claim brought against them by another Registered Provider for alleged breaches of lease regarding a large portfolio of properties. Tara successfully negotiated the matter with the Claimant which later resulted in a favourable settlement for the client.
  • Tara recently acted for a housing developer client in respect of a challenge to a planning decision regarding phosphates and subsequently made an application to the High Court for a Planning Statutory Review. The High Court refused the application at the first stage and granted a leapfrog certificate allowing an appeal to the Supreme Court. Tara made the necessary application and subsequent application to the Court of Appeal after the Supreme Court refused to hear the matter.
