Clarke Willmott is delighted to invite you to its webinar discussing the Prevention and Cure of problems with Farming Partnerships which is taking place on 25 July 2024 at 12:00pm.

This session will be hosted by agricultural legal experts Philip Whitcomb from our Private Capital team and Robert Mullen from our Commercial and Private Client Litigation team.

Farming in partnership is like a marriage. It can bring a lot of happiness and contentment but when it goes wrong it can go badly wrong for all concerned.

Has there been a discussion around the table? Does everyone understand how the business will run and do they all have the same expectations?

During this webinar we will take a look at the most common problems faced by those in farming partnerships and how to avoid them; the good, the bad and the ugly.

This session will cover:

  • What ‘good’ looks like in a written farm partnership agreement
  • How to spot misunderstandings or mistakes in farm partnership accounts and Wills
  • Where the red flags are in an existing agreement
  • Some of the issues that professionals face when advising modern farm partnership businesses

Unfortunately, farming families and their partnerships are often the perfect breeding ground for proprietary estoppel claims and so we will consider exactly what a proprietary estoppel claim is, how they tend to arise, the themes which come out of them and what warning signs to look out for.

Finally, we will look at what the future holds for the humble farming partnership and whether there is a future for them in the modern family run farming business.
