Advising The Insolvency Service and insolvency practitioners in actions against directors who have acted inappropriately.

John is an Associate in the Insolvency Team representing trustees, liquidators, and creditors in all manners of disputes arising from contentious insolvency.

John advises The Insolvency Service and insolvency practitioners in actions against directors who have acted inappropriately, including misfeasance, wrongful trading, and fraudulent trading claims pursuant to the Insolvency Act 1986 and the Companies Act 2006. John also advises on antecedent transactions, unlawful dividends, outstanding directors loan accounts, and enforcement including bankruptcy proceedings and winding up.

John is an Enterprise Adviser for the West of England Enterprise Adviser Network, working with schools and colleges, sharing expertise to help improve careers advice and work experience opportunities for young people.

Experience

John has over fifteen years of litigation experience dealing with a wide variety of claims and acting for both claimants and defendants. John joined Clarke Willmott in 2014 from DAC Beachcroft LLP where he specialised in defending professional negligence claims on behalf of professionals and their insurers and handling disputes in relation to insurance coverage issues.

As well as representing clients at trial, he has extensive experience of settling claims via alternative dispute resolution methods. He has represented clients at numerous mediations and without prejudice settlement meetings.
